THE RISKS TO YOUR STAFF
~ Corporate drivers stand a 1:8000 chance of being killed whilst driving on company business If they drive more than 30,000 miles per annum the risk increases to 1:250 More people die in work related road accidents than all other industrial and workplaces accidents put together. 25% of motorway accidents are directly related to fatigue. More than 1,000 deaths are road accident related compared to 622 deaths that happen in the workplace. 12,910 people are seriously injured in an at work road crash An estimated 91,000 individuals received slight injuries in minor at work road crashes. CORPORATE KILLING
~ On 23 May 2000 the Government published proposals for reforming the law on involuntary manslaughter, and accepted the Law Commissionâ??s proposals for the new offence of Corporate Killing. The corporate offence would be committed if â??gross carelessnessâ?? caused the death. A death will be regarded as being caused by the conduct of the company if it is caused by â??management failureâ?? in the way its activities are controlled. The
directors
or
managers
within the company could still be liable for the individual offences of reckless killing and killing by gross carelessness. The Government proposes that individual directors should be prosecuted and the definition of company is widely defined so that holding and subsidiary companies cannot avoid prosecution. |ddown~~
LEGAL RESPONSIBILITIES
~ The Heath and Safety at Work Act 1974 ² requires you to ensure, so far as is reasonably practicable, the health and safety of all employees while at work. You also have a responsibility to ensure that others are not put at risk by your work-related driving activities. (Self-employed people have a similar responsibility to that of employers). Under the Management of Health and Safety at Work Regulations 1999 ³, you have a responsibility to manage health and safety effectively. You need to carry out an assessment of the risks to the health and safety of your employees, while they are at work, and to other people who may be affected by their work activities. The Regulations require you to periodically review your risk assessment so that it remains appropriate. You are required to consult with your employees, and where applicable, their health and safety representatives, on the health and safety issues covered in this guidance. Health and safety law does not apply to commuting, unless the employee is travelling from their home to a location which is not their usual place of work. |ddown~~

~ Risk management and driving training as an integral part of your fleet safety can be carried out as on-road assessments and interactive presentations to ensure that your company drivers can safely and competently manage the vehicle you have provided for use in their daily work. COURSES
~ Our courses start with an interactive presentation which serves to introduce the clients to the concepts behind the type of course being undertaken. This is achieved by use of PowerPoint presentations, handouts and an analysis exercise. The aim of the presentation is to challenge attitudes and perceptions of todayâ??s drivers and the driving environment. Demonstration drives with commentary are given, followed by on-road training for course participants. The training ends with a debrief and recommendations. Final reports are delivered to the establishment. All course participants receive course notes and a copy of the Highway Code. |ddown~~
